2. APPLICABILITY
These Terms & Conditions (“Terms”) apply to all orders placed through the website of Gemak Collective VZW (“we”, “us”, “our”). By placing an order, you (“you”, “the customer”, “consumer”) accept these Terms.
3. PRODUCTS, PRICING & PAYMENT
All prices are in Euro (€) and include VAT, unless otherwise stated.
Payment must be made using the payment methods offered at checkout. The order is only final once payment has been received in full.
We reserve the right to modify product descriptions, availability or prices at any time, before the order is confirmed.
4. COLLECTION (Pick-up ONLY)
Orders placed online must be collected at a physical location agreed upon at the time of your order.No shipping or delivery services are provided.
Pick-up is only possible during our opening/collection hours, which will be communicated on the website or directly after the order.
5. RIGHT OF WITHDRAWAL / RETURNS
In accordance with European Union consumer protection laws:
You have the right to withdraw from your purchase within 14 calendar days without giving a reason. This period starts the day after you (or a third party you designated) collect(s) the product.
To exercise this right, you must inform us (via email at hello@gemakcollective.be) within the 14-day withdrawal period.
Items must be returned in the same condition as received: unused, unwashed, undamaged, and in original packaging.
You are responsible for the costs and logistics of returning the goods to our location.
Refunds (including the original payment) will be made within 14 days after we receive the returned goods.
Exceptions / limitations:
Certain products are excluded from the right of withdrawal (for example, custom-made items, perishable goods, opened hygiene items, etc.). This will always be stated clearly on the product page.
6. WARRANTY & DEFECTS
Belgium and EU law provides a 2-year legal warranty for consumer goods.
If you receive a product that is defective or not as described, please notify us within 7 days of collection by emailing hello@gemakcollective.be.
Depending on the situation, you may be entitled to a repair, replacement, or refund.
7. LIABILITY
We are not liable for indirect damages or for the consequences of incorrect information provided by the customer.
We are not responsible for delays in collection caused by the customer.
8. PRIVACY
We treat your personal data in accordance with GDPR and Belgian privacy law. Please see our Privacy Policy for details on how we collect, use, and store your data.
9. INTELLECTUEL PROPERTY
All content on the website (text, images, logos, branding) is our property (or used under license) and protected by copyright and intellectual property laws. You may not copy, reproduce, or reuse content without our written permission.
10. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by Belgian law.
Any disputes shall be handled by the competent courts of Leuven, unless mandatory consumer law specifies otherwise.
